GENERAL CONDITIONS OF SALE


"Etnic Art"
 
Article 1 - Introduction
These general conditions of sale apply to all sales offered by "Etnic Art" via your domain www.etnicart.it (the "Site"), in compliance with the rules on distance contracts (Article 50 and ss. Leg. n. 206/2005), together with the e-commerce law (Legislative Decree no. 70/2003) and, with regard to the protection of confidentiality, in accordance with Legislative Decree no. 196/2003.
By placing an order you declare that you have read, understood and accepted the following terms and conditions of sale. The conditions applicable to the individual order are those published on the Site at the time of order.
 
Article 2 - Purpose of the contract
This agreement "on-line", accepted on the website www.etnicart.it, means the agreement between AT IMPORT Srl, owner of the registered trademark "ETNIC ART", with registered office in Rome, Via del Crocifisso n. 51 c.a.p. 00165, P. IVA 08024251004 R.E.A. RM - 1068548, e-mail address info@etnicart.it, Fax 06-89275624 (hereinafter "Seller") and the consumer (hereinafter "Customer"), through the sale telematics system called e-commerce.
The term "consumer" as "any natural person who is acting for purposes unrelated to business, craft or profession" (Article 3 paragraph 1 letter. A) Legislative Decree no. N. 206/2005). These terms and conditions are valid, if accepted, even towards commercial customers. The latter does not explicitly apply the provision of art. 7 (right of withdrawal).
The contract is for the sale of furniture and furnishings in ethnic style or old. Items for sale are shown and described on the Site The images are indicative and may not be fully representative. Any imperfections that you may encounter are a sign of craftsmanship. In case of multiple purchases of the same product, any differences between the products are proof of the non-industrial and handicraft production that makes each piece unique and original. You can get via phone or email, and more specific information about each product using the appropriate form "Request Information".
The Etnical Art offers the service of transport of the goods to the address chosen by the customer. The sale and service delivery are only applied to the Italian territory. Etnical Art reserves the right not to accept / process an order if the delivery can not be guaranteed for reasons that will be communicated to the Customer, as well as the unquestionable right to refuse orders from customers who do not give sufficient guarantees of solvency or reliability.
 
3 - How to Buy
The purchase is allowed to a registered user, of legal age, which has:
a) created a personal account;
b) accepted the General Terms and Conditions;
c) read the information pertaining to the processing of personal data.
All transactions made through the login credentials are considered to be performed by the customer where the login credentials relate.
Before sending the order form, the Customer will have the opportunity to correct any errors in data entry and will have to read the terms and conditions of sale, as well as information on data processing, giving confirmation of the acknowledgment.
Before confirming the purchase, the customer will be shown the cost of each product chosen, the total cost when you purchase more products and transport costs. It is recommended to verify the correctness of the data entered in the "cart" before confirming the purchase.
After confirming the purchase, the customer will receive an e-mail message containing a summary of your order. In the case of non-acceptance, the Seller will inform the customer.
The order form will be stored in the database Etnical Art for the time necessary to execute the order. The customer can view their order within its own account in the "Orders".
Payment for the products will be using the method chosen by the customer when ordering. Nothing is more due by the Customer with respect to the total shown at the end of the purchase process.
The contract is concluded when Etnical Art accepts the order by sending a confirmation email after verification of the correctness of the data and payment.
The purchase can be made by the customer by phone or e-mail providing the data required for registration of the name, purchase order and method of payment.
 
Article 4 - Procedures and delivery costs
All orders confirmed by Etnical Art will be delivered to the shipping address specified at time of order by express courier or national carrier. The Customer is solely responsible for shipping address provided.
All deliveries shall be construed to street level, not at home or on the floor, without prior request notified by e-mail and premium rate. The delivery of products is carried out at the address indicated by the Customer within 30 days by the forwarding order. Etnical Art is not responsible for any delays caused by courier deliveries or transporting agent. The Seller shall, at the request of the Customer, Customer Service will provide the number of the courier, esonerandosi any liability on delivery. Where, exceptionally, the delivery is not executed within 30 days, the customer may cancel the order by giving notice to the express Etnical Art by fax or e-mail.
Etnical Art can not be held responsible for any loss, damage, or non-delivery caused by events and / or due to force majeure or unforeseeable circumstances, such as for example: natural disasters, adverse weather conditions, strikes or any means of transport accidents .
In case the delivery is successful for reason attributable to the customer, the order shall be deemed canceled and a penalty to the customer will be charged the cost of delivery.
Shipping costs in Italy are as shown at the time of purchase and include the cost of packaging.
It is necessary to indicate in the order form, a valid phone number, in order to allow the courier to contact the customer to arrange for delivery. The Customer may indicate in the notes field of the order form, the preference of certain days of the week and times for delivery.
In case of advance payment by bank transfer, shipment will be effected after receiving the payment.
For deliveries in the city and province of Rome is offered a transport service with delivery at home and not at street level.
You can pick up the products directly at the store in Rome, Via Giuseppe Galliano n. 18/26 indicating that choice in the order form. In this case, the Seller will contact the customer to arrange the day and time of the possible withdrawal of all products ordered.
 
5 - Availability of products
The Seller shall not be held responsible for the temporary or permanent unavailability of one or more products included in the order. If it is impossible to execute the order for unexpected unavailability of one or more products, Etnical Art will inform the customer by e-mail.
If the customer wished to cancel the order due to the unavailability of one or more products must give express notice, via email, within 2 days of notification of unavailability by Etnical Art Without it, the Seller shall execute the order limited to the available products and will pay promptly the amounts paid in excess by the customer.
 
Article 6 - Prices
The price applicable to the products ordered are those shown on the Website at the date of the order. The prices are expressed in Euro and are inclusive of VAT. Any promotional offers related to products published on the Site will be highlighted
Shipping charges will be shown separately on the Site at the time of order and be intended as inclusive of VAT. Shipping charges will vary because of the place of shipment, the weight / size of the neck, and, in some cases, size of the order. Any promotions for the Delivery costs will be shown on the Site
Etnical Art execute the purchase order only after receiving confirmation of authorization to pay the total amount due, consisting of the purchase price, delivery charges and any additional cost, as indicated in the order form.
 
Article 7 - Right of withdrawal
Customer "Consumer" shall have the right, within 10 working days from receipt of the goods required, to exercise the right of withdrawal (Article 64 of Legislative Decree no. 206/2005).
To exercise the right of withdrawal, the customer must send a registered letter with return receipt requested, or by fax, mail or telegram, confirmed by letter within the next 48 hours, at the following address:

The recommended means sent in good time if postmarked before the deadline. The customer must return the goods within fifteen days of the notice of withdrawal.

Article 8 - Obligations of the buyer
The general conditions of sale shall be examined online by the customer before making an order. The submission of the confirmation of the order implies full knowledge of these general conditions of sale and their full acceptance.
The Customer shall purchase the products in consultation with the descriptions on the Site and is solely responsible for the choice and suitability of the product for the purpose.
The Customer undertakes to print the General Conditions and / or store them on a durable medium in order to meet the requirement of Article. 53 of Legislative Decree no. 206/2005.
It is the obligation of the customer to check the conformity of the products delivered to those ordered and in particular the integrity and the absence of exterior defects. After this check, the customer must sign the delivery note. Following the subscription, the customer can not make any objection about the appearance of what was delivered to him in relation to the order made. If, however, there is a correspondence between the order and delivery, the Customer must not accept the goods and complain directly and immediately to the carrier. Only in the latter case, the customer will not be charged any fees.
 
9 - Privacy policy

Article 10 - Payments
The balance inherent in the purchase of products purchased and the shipping costs, if any, shall be made by the Customer using any of the following means of payment:
 
• Paypal and Credit card and prepaid Visa, Visa Electron or Mastercard. Payment must be made within two days of order confirmation. Otherwise, the order will be canceled recorded;

Article 11 - Jurisdiction and Venue
This agreement shall be governed by Italian law. For any dispute arising in connection with the validity, interpretation or execution of the contract, the local jurisdiction will be the court of the place of residence or domicile of the customer, if located in the territory of the State.
For the same dispute which may arise between the Vendor and a Customer "commercial", is the court of Rome.

Article 12 - Purchase of products TYPE " They can be ordered "

Once the order is received the items requested will be sent to production to allow for delivery in the shortest possible time (usually 2-3 months) , however, and in 99% of cases in a period of less than 6 months

As soon as the items will be ready for delivery the Seller will contact the customer to ask for the balance ( if necessary , ie the second order mode ) and agree on the dates of shipments

The Seller shall , on receipt of the balance, if any , will be responsible for shipping and transportation service that was chosen during the order ( in the street or on the floor)

In the case of orders of mixed type ( products ordered and products ready for delivery ), the shipment will be made only once, and that is also when the products ordered have been received at our warehouse (as in the manner described above ) .

If you wish to receive in advance the items ready for delivery, you will need to make two separate orders .
